We recently reported that Apple had won an injunction in a court in Germany to block Samsung from selling their Galaxy Tab 10.1 across Europe.
Today however the ban was lifted for all countries across Europe except in Germany where the ban still applies.
The on-going patent war between tech giants Apple and Samsung has been going on for quite a few months now with both parties having claimed copyright infringements against each other. A ruling by a regional court in Dusseldorf, Germany granted an injunction to Apple recently, which blocked the sale and advertising of the Galaxy Tab 10.1 across Europe.
Samsung had complained that the ruling had happened without them knowing and no-one from Samsung was present for the hearing. A spokesman at the court in Düsseldorf today said: “It is not clear if the court can forbid a company based in Korea to sell its products in other countries than Germany.”
So although the ban has been lifted they still can’t sell the Galaxy Tab 10.1 in Germany, a ruling Samsung will still contest. The case is due back in court on 25th August when Samsung will hope to get the ban lifted in Germany.
A spokesperson for Samsung said: “Samsung welcomes the Dusseldorf District Court’s decision to suspend the pan-European preliminary injunction against the Samsung Galaxy Tab 10.1.”
“Samsung is fully committed to providing our innovative mobile devices to the market without disruption, and ensuring that consumers have a wider selection of innovative products to choose from. We look forward to the opportunity to reassert our intellectual property rights at the hearing scheduled on August 25.”
Meanwhile an investigation has discovered that at least one of the pictures of the Galaxy Tab that Apple submitted to the court as evidence had been manipulated. Apple declined to comment on the findings.
