So it seems Samsung are keeping good to their word and going after the iPhone 4S. Samsung promised they would be going after the next iPhone, following countless lawsuits from Apple against them they have become much more aggressive in their pursuit against Apple products.
They have filed separate preliminary injunction motions in France and Italy, if successful it would prevent sales of the iPhone 4S in both countries and would be a huge victory for Samsung in the on-going patent war between the two tech giants.
On its official blog, Samsung issued the following statement:
Samsung Electronics will file separate preliminary injunction motions in Paris, France and Milano, Italy on October 5 local time requesting the courts block the sale of Apple’s iPhone 4S in the respective markets.
Samsung’s preliminary injunction requests in France and Italy will each cite two patent infringements related to wireless telecommunications technology, specifically Wideband Code Division Multiple Access (WCDMA) standards for 3G mobile handsets.
The infringed technology is essential to the reliable functioning of telecom networks and devices and Samsung believes that Apple’s violation as being too severe and that the iPhone 4S should be barred from sales.
Apple has continued to flagrantly violate our intellectual property rights and free ride on our technology. We believe it is now necessary to take legal action to protect our innovation.
Samsung plans to file preliminary injunctions in other countries after further review.
Samsung and Apple have lawsuits filed in many different countries, with Apple being successful in blocking the sales of Samsung’s Galaxy Tab in Germany and Australia. To date Samsung have been unsuccessful in blocking the sales of any Apple products.
Samsung recently offered Apple a deal in Australia, that would have allowed Samsung to start selling the Galaxy Tab in Australia again by the end of the year, however Apple rejected the offer.
